These terms are an agreement between you and Pera101 about your use of the Detective mobile application. By downloading, opening or using Detective, you accept them. If you do not accept them, please do not use the app.
Detective lets you submit a photo and returns links to publicly accessible web pages on which a face-search provider has found a visually similar image. The search is carried out by a third-party provider, not by Pera101.
Detective searches only material that is already published on the open web. It does not access private accounts, private databases or non-public records.
You must be at least 18 years old and legally able to enter into this agreement. If you use Detective on behalf of an organisation, you confirm that you are authorised to accept these terms for it.
You are responsible for every photo you submit. By submitting a photo you confirm that you have a lawful purpose for doing so and that you are legally permitted to submit that image in your jurisdiction.
Some countries and regions regulate biometric and facial data strictly, and may require the consent of the person shown before their image is processed. It is your responsibility to know and follow the law that applies to you. If you are unsure, do not submit the image.
You must not use Detective for any of the following. This list is not exhaustive, and we may end your access for conduct we reasonably consider abusive even if it is not listed here.
Detective reports visual similarity between images. Visual similarity is not identification. A result does not prove that two images show the same person, and different people can produce very similar matches.
You must not treat a result as confirmation of anyone's identity, and you must not present it to anyone else as such.
Results come from third-party websites and from a third-party search index. They may be incomplete, inaccurate, out of date, mislabelled, or relate to a different person altogether. Pages may also change or disappear after they are indexed.
We do not review, endorse or verify the content of any page that appears in your results, and we are not responsible for it. Detective is provided for general informational use only.
Detective must not be used, in whole or in part, as a factor in any decision about a person's eligibility for employment, credit, housing, tenancy, insurance, education, healthcare, government benefits, or any other similar decision.
Detective is not a background-check service, a consumer reporting agency, or a source of consumer reports, and its results are not consumer reports. If you are in the United States, this means Detective must not be used for any purpose regulated by the Fair Credit Reporting Act.
Detective depends on third-party services, including its face-search provider and the app stores through which it is distributed. Your use of those services is also subject to their own terms.
Results link to websites operated by third parties. We do not control those sites and are not responsible for their content, their accuracy or their privacy practices.
Some features of Detective require a paid subscription. Prices, subscription lengths and what each plan includes are shown in the app and in the relevant app store before you confirm a purchase.
Payment is taken by the Apple App Store or Google Play, depending on where you downloaded the app. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within the 24 hours before the period ends.
If a free trial is offered for a plan, the terms of that trial are shown at the point of purchase. Where a trial converts into a paid subscription, the subscription begins automatically when the trial ends unless you cancel before that point. Any unused part of a trial is forfeited when you buy the corresponding subscription.
You manage and cancel your subscription in your Apple App Store or Google Play account settings, not in the app. Cancelling stops future renewals; it does not shorten the period you have already paid for, and you keep access until that period ends.
Refunds are handled by the store that took the payment and are governed by that store's refund policy. We are generally not able to issue a refund for a purchase made through a store. Any statutory right of withdrawal or refund you have under consumer law in your country is unaffected by this section.
Detective, its name, its interface and its underlying software belong to Pera101 and are protected by intellectual property law. These terms give you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app for its intended purpose.
You may not copy, modify, distribute, sell, sublicense or create derivative works from the app, or remove any proprietary notice from it.
We may suspend or end your access to Detective, with or without notice, if you break these terms, if we reasonably suspect abusive or unlawful use, or if we are required to do so by law or by a provider we depend on.
You can stop using Detective at any time by deleting the app and cancelling any subscription through the relevant store.
Detective is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranty that the service will be uninterrupted, error-free or secure, or that results will be accurate, complete, current or fit for any particular purpose.
Nothing in these terms excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you as a consumer.
To the fullest extent permitted by law, Pera101 is not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, data, goodwill or reputation, arising out of your use of Detective or your reliance on its results.
To the fullest extent permitted by law, our total liability for any claim relating to Detective is limited to the amount you paid us for the app in the twelve months before the event giving rise to the claim.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
You agree to indemnify Pera101 against any claim, loss or cost arising from your misuse of Detective, from your breach of these terms, or from your breach of the law or of another person's rights in connection with an image you submitted.
We may change, suspend or discontinue any part of Detective, and we may update these terms as the app or the law changes. When we update them we will revise the date shown at the top of this page.
If a change is material, we will make a reasonable effort to tell you in the app. Continuing to use Detective after a change takes effect means you accept the updated terms.
These terms are governed by the laws of the Republic of Türkiye, and the courts of İstanbul have jurisdiction over any dispute arising from them.
If you use Detective as a consumer in another country, this does not deprive you of the protection of any mandatory provision of the law of the country where you live, or of your right to bring proceedings there where the law gives you that right.
